In June 2004, the Iowa Supreme Court upheld
a lower court decision that struck down nuisance lawsuit protection
for factory farms, saying it “violated the rights of nearby
property owners.” The ruling is a victory for family farmers
and rural residents.
A number of successful nuisance lawsuits
have been filed in the past several years, providing some compensation
to families whose property was devalued by factory farms. Below
is more information about how to proceed if you’re considering
legal action because your property or quality of life has been negatively
impacted by a nearby factory farm.
While money cannot make up for the damage
caused by factory farms, neighbors of mega-confinements can be financially
compensated for:
- Loss of enjoyment of life
- Annoyance
- Personal injury
- Emotional stress
- Property devaluation
Individuals who are considering filing a
nuisance lawsuit against a factory farm should keep
good records and have documentation on the effects the facility
has had on their property value, water, health, and quality of life
